The Erwin File¶
Dr. Cheryl Erwin, J.D., Ph.D., is the Director of the Center for Ethics, Humanities & Spirituality at TTUHSC's School of Medicine. Kevin first wrote to her about professionalism coaching in July 2023. On August 8, 2023 the School of Medicine's professionalism committee (SPPCC) required him to complete an educational activity under her direction, and she served as his professionalism coach through October 2023.
This page places three sets of records side by side: what Dr. Erwin wrote to Kevin by email, what she wrote about him in the institutional file (seen during Kevin's January–February 2026 FERPA inspection and cited in the federal complaint), and what she said at the December 11, 2023 dismissal hearing. No characterization is added; readers can compare the records themselves.
How each set is quoted. Her emails are quoted word for word from the messages themselves; where part of a message is left out, the omission is marked with an ellipsis. Her file notes are quoted from Kevin's handwritten transcription made during the inspection, because TTUHSC allowed him to read the records but did not provide copies. Her hearing statements are quoted from an automated transcript of the hearing recording, and the Board's letter from the letter itself.
What she wrote to Kevin¶
Emails from her TTUHSC account, September–October 2023 (The Paper Trail):
September 7, 2023 (replying to Kevin's apology for having been irritable while ill at the previous day's session): "Thank you Kevin. And thank you for making our meeting. You were lovely. See you next time."
October 17, 2023: "Your call, either way I just want you to feel supported."
October 19, 2023: "Just breathe!! You're gonna be fine. I will continue to coach you through this."
October 29, 2023: "Kevin, I am crying as I read this. For the pain you have been through. For the joy of your survival. For the dreams and goals you still hold. I can walk alongside you and I can be your friend. I can listen to you as you find your authentic self. But I would never want to change who you are and I couldn't even if I wanted to. … I am not sure there is continued value in a coaching relationship, but I will not abandon you. You have work to do my friend, and it is the work of healing. … Your friend, Dr. Erwin"
What she wrote in the file¶
Coaching notes from the same period, as they appear in Kevin's education records (FERPA Evidence Index):
FERPA Doc 0124 — coaching notes dated August 22, 2023:
"The social media issues came up. They cannot be ignored. They raise issues of constitutional free speech, due process, and reputational harm... In the present he seems to be taking his First Amendment rights to make an idiot of himself."
"KB has imbibed the cultural atmosphere of conspiracy theories. This is reflected in his combative attitude towards me and everyone who is trying to help him, as well as towards the CDC response to COVID as a conspiracy."
In the same document, Erwin wrote that "coaching may be utterly ineffective if the mental health issues are not resolved." The record does not reflect a referral to disability services. (Complaint ¶¶39(b), 42)
Coaching notes, entry dated November 29, 2023 (Kevin's inspection notes do not record a document number for this entry). Kevin had filed his state-court lawsuit on November 13, 2023:
"Because I had reformulated our relationship as friendship rather than coaching I consider a legal action against my employer a direct disregard of and abandonment of our friendship."
FERPA Doc 0137 — coaching form dated August 9, 2023:
"Stop and think about what you really want. You love the attention from social media but recognize that a lot of people in your real life have stopped talking with you. Which do you really want?"
FERPA Doc 0132 — coaching goal memo. Created August 10, 2023; the document metadata shows it was last saved December 11, 2023 — the day of the dismissal hearing:
"Goal: overarching goal is to find a path for K to stay in med school. Outcome: moderating his behavior, especially his communications with others."
What she said at the hearing¶
At the December 11, 2023 hearing (The Hearing):
- Dr. Erwin was added as a witness the same morning: hearing officer Gibson stated, "I'm going to allow Dr. [Erwin] to be added as a witness." In the same proceeding, Kevin's neuropsychologist — the only expert who could provide clinical context — was denied because "the university did not have time to identify [a] rebuttal witness." (Complaint ¶50)
- On the question of threat, Erwin testified: "I don't take that to be a threat from you... I get who you are." (Complaint ¶180)
- The Board later described Wilson's and Erwin's testimony as "particularly relevant" because "based on their observations, they did not believe Dr. Bass was fit to continue as a medical student based on professionalism concerns." (Complaint ¶142)
The same-period comparison¶
| Date | To Kevin | In the file |
|---|---|---|
| Sept–Oct 2023 | "You were lovely." · "I just want you to feel supported." · "Just breathe!! You're gonna be fine." | "Taking his First Amendment rights to make an idiot of himself." · "Imbibed the cultural atmosphere of conspiracy theories." |
| Oct 29, 2023 | "I would never want to change who you are … I will not abandon you. … Your friend, Dr. Erwin" | — |
| Nov 29, 2023 (after the Nov 13 lawsuit) | — | A lawsuit would be "a direct disregard of and abandonment of our friendship." |
| Dec 11, 2023 | — | Goal memo last saved the day of the hearing: "moderating his behavior, especially his communications with others." |
Unknowns / what would change this¶
- The coaching notes are quoted from Kevin's handwritten transcription of the education records he was shown at FERPA inspection. TTUHSC did not provide copies, and the full documents have not been publicly released. If the institution releases them, they will be linked here and the quotations checked against them.
- Kevin's inspection notes do not record a document number for every entry. Where the number is uncertain, this page says so rather than guessing.
- Corrected September 19, 2026. An earlier version of this page described her four messages as text messages (they are emails); printed the October 29 email without marking omitted sentences; quoted the coaching note as "would be utterly ineffective" (the note reads "may be"); attributed the "Stop and think" passage to Doc 0083 (it is Doc 0137); and placed the November 29 note beside the October 29 email under a single date. It also said she was assigned in August 2023; Kevin first contacted her in July.
- No claim is made here about Dr. Erwin's intent or motive. The page presents the records; readers can draw their own conclusions.
