BASS, § 8 Plaintiff, § § v. § No. 5:25-CV-244-H-BV § TEXAS TECH UNIVERSITY HEALTH = § SCIENCES CENTER, et al., § Defendants. § § ORDER GRANTING LATE RESPONSE BRIEF On January 21, 2026, Defendants filed a motion to dismiss, making pro se Plaintiff Kevin Bass’s response brief due by February 11. Dkt. No. 27. One day after Bass’s deadline expired, he filed a motion to extend the deadline.! Dkt. No. 29. The motion did not specify the length of extension Bass wanted, and although it was titled as an unopposed motion, Bass did not include a certificate of conference in compliance with the local rules. Jd. As it turns out, Bass did not yet know whether Defendants opposed the motion because he did not meaningfully confer with opposing counsel until after filing the motion. Dkt. No. 31 at 1 (stating that on February 12 he conferred via email with opposing counsel and confirmed Defendants were unopposed). ! The motion is dated February 11, but it was not filed until February 12 because Bass did not upload the document until after 11:59:59 p.m. Dkt. No. 29. Case 5:25-cv-00244-H-BV Document 52 Filed 07/14/26 Page 2 of 2 PageID 1535 Three days after his original motion, Bass filed an amended motion asking for a three-day extension. /d. Defendants do not oppose a three or four day extension. 7d. Bass filed his response to the motion to dismiss the same day. Dkt. No. 33. Bass did not timely move for an extension, but Defendants do not oppose his request. Moreover, he filed his response four days after the deadline, so any delay was minimal. The Court therefore GRANTS Bass’s amended motion for an extension and will consider his response timely. DENIED as moot. Dkt. No. 31. Bass’s original motion for extension is Dkt. No. 29.
