IN THE UNITED STATES DISTRICT COURT
FOR THE NORTHERN DISTRICT OF TEXAS
LUBBOCK DIVISION

AMY PICKETT,
Plaintiff,

§ CIVIL ACTION NO. 5:20-CV-232-H-BQ

v.

TEXAS TECH UNIVERSITY HEALTH

SCIENCES CENTER (TTUHSC), et al.,
Defendants.

ORDER

Before the Court is pro se Plaintiff Amy Pickett·s second motion for extension of time to
(1) respond to Defendants· discovery requests, and (2) file a response to Defendants· FED. R. CIV.
P. 12(c) motion (ECF No. 58). ECF No. 61; see ECF No. 60. On May 3, 2023, the Court granted
Pickett·s motion to extend the deadlines until May 15, 2023. ECF No. 60. Pickett now asks the

Court to further extend those deadlines until May 30 because she ·had been out sick with Covid.·¹
ECF No. 61, at 2. The certificate of conference attached to the motion indicates Defendants do
not oppose an extension of the Rule 12(c) response deadline. Id. at 3. But Defendants do oppose

an extension of the discovery cutoff to May 30 because the Original Rule 16 Scheduling Order·s
discovery deadline expires June 23, 2023. Id.; see ECF No. 52, at 3. Nevertheless, Plaintiff
represents that Defendants agree to extend the discovery responses deadline to May 19. ECF No.
61, at 3.

¹ The primary basis for Pickett·s request appears to be her belief that under N.D. Tex. Local Civil Rule 6.1, she could
have originally requested an extension of up to twenty-eight days. ECF No. 61, at 1·3 (stating that she ·learned [she]
could request for a time extension that did not exceed 28 days, [p]ursuant to Local Rule 6.1·). Pickett is mistaken.

Local Rule 6.1 relates to the time ·[a] pleading, motion, or other paper· is deemed filed. See N.D. TEX. LOC. CIV. R.
6.1. It does not set the bounds for extensions of time.

Because the deadlines at issue expire May 15, prior to Defendants' twenty-one day time to
respond to Pickett's motion, the Court relies on representations made by Pickett in the certificate

of conference and hereby GRANTS the motion as follows. ECF No. 61. Pickett shall file her
responses to Defendants' discovery requests no later than May 19, 2023. Pickett must file any
response to Defendants' Rule 12(c) motion no later than May 30, 2023. The Court will not grant
Pickett any further extensions as to these two deadlines.
SO ORDERED.

Dated: May 12, 2023.
